New York State Supreme Court judge Jeffrey K. Oing issued an order Monday that could help determine whether or not the National Football League knew about the dangers of concussions for years before those dangers became widely known and deliberately concealed facts about brain trauma from its own players.
The NFL and the players reached a concussion settlement that reportedly could reach $1 billion in August 2013. The NFL is asking the insurers that wrote policies for the league to cover the settlement damages and the league’s legal costs.
However, the insurers have refused to pay because they believe the NFL might have committed fraud, which they believe would resolve them of any responsibility to pay out a settlement.
Oing’s ruling allows the insurers to proceed with discovery, which could unearth damaging NFL records.
